BCB reluctant to go a new legal battle with Nimbus

Bangladesh Cricket Board (BCB) decided not to go with another legal battle with Nimbus Sports as they don’t see any future in it.


The groundbreaking six-year-deal of staggering US$56.88 million was signed in July 2008 after the Head of Agreement of the contract was penned in November 2006. But the deal was ended in July 2012 the deal since became a big thorn for BCB.


Nimbus still owes the BCB US$22 million and the board has been fighting since then to recollect the figure through their legal war.


However, Nimbus Sports got bankrupted recently and the court of Singapore sent a letter if BCB have any objection on their decision and if they have anything to say, they can the file another case on Nimbus within the next 21-day time frame, which might cost BCB another two lakh dollars to take the case forward.

The BCB took the advice of Attorney General Mahbubey Alam, the highest law officer of the country, to take a good decision to this end.


It’s leant that Alam said he could not find any reason to go to this fight and advised him to avoid the additional cost of two million dollars. Allen & Gladhill and Tanjib Alam & Associates, two Singapore-based legal consulting firms also gave the same opinion. So on 6 June, BCB withdrew them from the second fight by sending a ‘no-objection letter’ to the Singapore court.


BCB chief executive Nizamuddin Chowdhury confirmed the matter to a Bengali Daily and said that his relief of saving the extra expenses by giving no objection to the Singapore court.


“Nimbus has been declared completely bankrupt. That’s why we didn’t find its legal ‘merit’. A legal battle is still going on in the court of Singapore. This would have been another matter of excess. As they’ve gone bankrupt, we thought it would be best not to go any further behind it. The decision was made on the advice of lawyers,” Nizamuddin said.


“If we did not give a no-objection letter, we would have to go to another fight outside the legal battle. In that case, we would have incurred additional costs. We didn’t get involved because we don’t see any bright future in it. Just avoided the extra cost,” he added.


However, the legal battle will continue, said Nizamuddin Chowdhury.


“There is no chance of forgiving Nimbus. The legal process will continue. Not due, I would say it ‘claim’. Which number gets valid in the end is the next thing. But it is true that we have very little chance of getting anything from them,” he added.


“The fight is on the battlefield. If it happens that something was ever found in the future [of Nimbus]. Suppose something solid came out. So that then we can have something. That is why we’ll continue to fight,” Nizamuddin concluded.
